Amused

Chapter 8: The Courtroom Trap

At 6:15 the next morning, Daniel called me.

"Michael, we have a problem.""

I was already awake.

Lily was sleeping beside me, her stuffed rabbit tucked beneath her chin.

"What happened?""

"Richard has filed an emergency petition seeking temporary guardianship of Brandon and Lily.""

I sat upright.

"Brandon, too?""

"Yes. He's claiming Vanessa is being unfairly targeted and that both children need protection from the conflict.""

I looked at Lily.

"Can he get it?""

"Not without evidence. But the hearing is scheduled for nine, and the petition includes that edited recording of you.""

I rubbed my forehead.

"What else?""

Daniel hesitated.

"He's submitted an affidavit from a former employee who claims you've been emotionally unstable and neglectful since Sarah died.""

"Who?""

"Andrew Mitchell.""

I closed my eyes.

Of course.

Andrew had finally stepped out of the shadows.

"Is the affidavit signed?""

"Yes. And notarized.""

"Then we'll prove it's false.""

"Michael, there's another problem.""

"What?""

"Vanessa has agreed to testify.""

I stared at the hotel wall.

"Against me?""

"She's claiming you threatened her, neglected Lily, and used your business travel to avoid parenting responsibilities.""

I looked toward my daughter.

For six months, I had been telling myself that working long hours was the price of keeping our lives stable.

Now those same absences were being used against me.

"Daniel, what do we need?""

"Everything. School attendance records, medical records, financial transfers, testimony from Lily's teachers, and the original recordings.""

I stood and walked toward the window.

"Get it.""

"We're trying.""

"No. Get it.""

My voice sounded harsher than I intended.

Daniel was quiet.

Then he said, "Michael, we also need to discuss whether Lily should testify.""

I turned.

"Absolutely not.""

"She's the person Vanessa allegedly pressured into signing the documents.""

"She's eight years old.""

"I know. The judge may allow a private child interview, but we can request that she not be placed in open court.""

I looked at Lily sleeping.

"Whatever happens, she is not going to sit in front of those people and defend herself.""

Daniel sighed.

"Then I'll make that request.""

At eight-thirty, we entered the courthouse.

Vanessa was already there.

She wore a cream-colored suit and carried a leather handbag. Her hair was perfectly styled.

Richard Hale sat beside her.

Andrew Mitchell stood behind them.

When Vanessa saw me, she smiled.

Not warmly.

Triumphantly.

"Michael.""

I kept walking.

She stepped closer.

"I hope you've thought carefully about what you're doing.""

I stopped.

"You should be worried about what you've done.""

Her smile disappeared.

Richard extended his hand.

"Michael. We haven't had the pleasure of meeting properly.""

I looked at his hand.

Then at him.

"I know exactly who you are.""

He lowered it.

"Then perhaps we can avoid unnecessary hostility.""

"Stay away from my daughter.""

Richard smiled faintly.

"That depends on the court.""

Daniel touched my shoulder.

"Let's go.""

The hearing began at nine.

The courtroom was smaller than I expected.

A judge sat behind a raised wooden bench. Two attorneys represented Richard and Vanessa.

Andrew was seated near the back.

I recognized the judge's name from previous business cases.

Judge Eleanor Whitman.

She reviewed the petition before looking at both sides.

"This is an emergency guardianship matter involving two minor children. I expect everyone to remain focused on their welfare.""

Richard's attorney stood first.

"Your Honor, our petition concerns a father who has been largely absent from his daughter's life and a household environment that has become increasingly unstable.""

Daniel rose.

"We strongly object to that characterization.""

The judge raised a hand.

"You'll have your opportunity.""

Richard's attorney continued.

"Mr. Carter has spent significant periods traveling for business. During those absences, Mrs. Carter provided daily care for the child.

Recently, Mr. Carter removed Lily from the household without notice and began making accusations against Mrs. Carter.""

I felt my jaw tighten.

The attorney placed the edited recording into evidence.

The courtroom speakers played my angry voice.

"Get out of my house, Vanessa! If you ever touch Lily again, I'll make sure you regret it!""

Vanessa lowered her head.

She looked almost tearful.

Richard's attorney paused the recording.

"Your Honor, this demonstrates a pattern of intimidation.""

Daniel stood.

"Objection. The recording is incomplete and materially altered.""

"On what basis?""

"We have forensic evidence showing that multiple conversations were combined.""

The judge looked toward the clerk.

"Has the original recording been submitted?""

Daniel nodded.

"We have requested expedited authentication.""

The judge made a note.

"Proceed.""

Andrew was called to testify.

He walked to the witness stand wearing a dark suit.

He looked at me briefly.

Then he turned toward the judge.

"Mr. Mitchell," Richard's attorney asked, "how long have you known Michael Carter?""

"Eleven years.""

"And have you observed changes in his behavior following his wife's death?""

Andrew hesitated.

"Yes.""

"What changes?""

"He became increasingly withdrawn. He spent long hours at work. There were occasions when he became angry over minor matters.""

I stared at him.

"Did you ever witness him mistreat his daughter?""

Andrew looked at the attorney.

"I witnessed him lose his temper.""

"With Lily?""

"Yes.""

Daniel stood.

"Can you provide a date?""

Andrew frowned.

"I don't recall the exact date.""

"An approximate date?""

"Several months ago.""

"Where did this occur?""

"At the family home.""

"Who else was present?""

"Vanessa.""

Daniel nodded.

"And did you report this incident to the police?""

"No.""

"Did you report it to child services?""

"No.""

"Did you report it to anyone?""

Andrew hesitated.

"No.""

Daniel walked toward the evidence table.

"Mr. Mitchell, are you aware that your company access was suspended yesterday?""

Andrew shifted in his seat.

"Yes.""

"Because of suspected unauthorized access to a financial trust account?""

"I don't know anything about that.""

"Did you attempt to access the account after your credentials were suspended?""

"No.""

Daniel placed a printed security log in front of him.

"Then perhaps you can explain this entry.""

Andrew looked down.

His face changed.

"That's not my personal account.""

"But the login originated from your assigned workstation.""

"I can't speak to that.""

Daniel returned to his seat.

"No further questions.""

I looked at Andrew.

He refused to meet my eyes.

Vanessa was next.

She took the witness stand with a tissue in her hand.

Richard's attorney asked her to describe her relationship with Lily.

"I loved that little girl as if she were my own.""

I nearly laughed.

Vanessa continued.

"I tried to provide structure after Sarah died. Michael was rarely home. Lily became difficult, and I did everything I could to help.""

"Did you ever deny her food?""

"Never.""

"Did you ever ask her to sign documents?""

Vanessa lowered her eyes.

"She sometimes wanted to help with household paperwork. She would copy words or write her name. I never forced her.""

Daniel stood.

"Mrs. Carter, do you recognize this document?""

He showed her the practice sheet found beneath the kitchen table.

Vanessa looked at it.

"Yes.""

"Did you write the words at the top?""

"No.""

"Did you ask Lily to practice Michael Carter's signature?""

"Absolutely not.""

Daniel placed another document in front of her.

"Then why does this handwritten instruction appear beneath your own signature?""

Vanessa stared at the page.

Her expression tightened.

"I don't know.""

Daniel read the sentence aloud.

"Make it look exactly like Daddy's. Don't forget the middle initial.""

The courtroom became silent.

Vanessa dabbed her eyes.

"I was trying to teach her handwriting.""

Daniel nodded slowly.

"By teaching an eight-year-old to imitate her father's signature?""

"No!""

"Then why did she need to practice his name?""

"She wanted to.""

"Did she also want to practice signing an authorization transferring control of her inheritance?""

Vanessa's voice rose.

"I never stole anything!""

Daniel placed the attempted trust transfer on the table.

"Then perhaps you can explain why your name appears as the proposed administrator.""

Vanessa looked toward Richard.

Only for a second.

But the judge noticed.

"Mrs. Carter, please answer the question.""

Vanessa swallowed.

"I was trying to help.""

Daniel returned to his seat.

"That will be all.""

Then Richard's attorney made a request that changed the atmosphere.

"Your Honor, we would like to call the minor child, Lily Carter, for a brief interview.""

I stood immediately.

"Absolutely not.""

The judge looked at me.

"Mr. Carter, please sit.""

Daniel rose.

"We respectfully oppose open testimony from an eight-year-old child. If the court requires information from Lily, we request a private interview conducted by a qualified child specialist.""

The judge considered it.

"Granted. The child will not be questioned in open court.""

I exhaled.

But Richard's attorney wasn't finished.

"We also request that the court consider the child's handwritten statement.""

He presented a single sheet.

I recognized Lily's handwriting.

My stomach tightened.

The document stated:

I want Grandma Vanessa to take care of me because Daddy is always away. I want to live with Grandma and Brandon.

At the bottom was Lily's signature.

The courtroom seemed to tilt.

Daniel stood.

"Your Honor, we have evidence that this statement was obtained through coercion.""

Richard's attorney replied, "That's a serious accusation.""

"Then we welcome an investigation.""

The judge examined the paper.

"Was this signed voluntarily?""

Vanessa wiped her eyes.

"Yes, Your Honor. Lily wanted to stay with me.""

I stared at her.

She had taken a frightened little girl, convinced her that her father didn't want her, and turned those fears into a legal document.

I wanted to stand up and shout.

Instead, I gripped the edge of the table.

Then the courtroom door opened.

Detective Harris entered.

She approached the clerk and handed over a sealed envelope.

The judge looked at it.

"What's this?""

Daniel stood.

"Your Honor, this is the preliminary forensic report concerning the recordings submitted by the opposing party.""

The judge opened it.

She read the first page.

Then the second.

Her expression became unreadable.

"Counsel, I believe we need to address the authenticity of the evidence presented today.""

Richard's attorney stood.

"We haven't had an opportunity to review that report.""

"Then you'll have an opportunity now.""

The judge passed the report to the clerk.

Daniel looked at me.

The report confirmed that the recording had been edited.

But there was more.

The original audio contained a completely different conversation.

One in which Vanessa had threatened to remove Lily from the home if she didn't sign the documents.

And the person who had edited the recording was Andrew Mitchell.

The judge called a recess.

I turned toward Vanessa.

She wasn't crying anymore.

She was staring at Andrew.

He leaned toward her and whispered something.

She shook her head.

Then Richard stood and walked toward the courtroom exit.

Detective Harris immediately moved to intercept him.

"Mr. Hale, I need you to remain available.""

He smiled.

"Am I under arrest?""

"Not at this moment.""

He glanced at me.

"Enjoy your temporary victory, Michael.""

Then he leaned closer.

"You should ask your daughter what Sarah told her on the last night.""

I froze.

"What?""

Richard smiled.

"Because Sarah didn't leave you the whole story.""

He walked away.

During the recess, Daniel received a call from the child specialist.

She had interviewed Lily privately at the courthouse.

Her findings were brief.

Lily had described being told that her father no longer wanted her.

She had also described being threatened with punishment if she refused to practice signatures.

But there was something else.

The specialist said Lily had mentioned a second set of documents.

Documents Vanessa had shown her shortly before Sarah died.

I felt my stomach tighten.

"What documents?""

Daniel listened.

Then he looked at me.

"An agreement Sarah supposedly made with Vanessa.""

I shook my head.

"Sarah would never have done that.""

"That's what we need to establish.""

Daniel ended the call.

Then he opened the scanned copy of the alleged agreement.

I read the first paragraph.

It claimed Sarah had voluntarily agreed to appoint Vanessa as Lily's future guardian.

The signature appeared genuine.

I looked closer.

The date was two weeks before Sarah died.

My stomach turned.

"That's impossible.""

Daniel leaned forward.

"Why?""

"Because Sarah was unconscious that entire week.""

He looked at the document again.

Then he noticed something.

A witness signature.

*Andrew Mitchell.*

The same man who had forged my signature.

The same man who had edited the recording.

And apparently the man who had witnessed a document signed by my dying wife while she was unconscious.

I looked toward the courtroom.

Vanessa was whispering urgently to Richard.

Andrew was nowhere to be seen.

Then Daniel's phone rang.

He answered.

Listened.

And slowly stood.

"What happened?"" I asked.

He covered the phone.

"Andrew Mitchell has disappeared.""

I stared at him.

"Disappeared where?""

Daniel returned to the call.

Then he said something that made my blood run cold.

"Michael, the police just found his car outside your house.""

I stood.

"Is Lily there?""

Daniel shook his head.

"No.""

"Then what's the problem?""

He swallowed.

"They found the back door open.""

My heart began pounding.

"Was anyone inside?""

Daniel looked at me.

"Yes.""

"Who?""

His voice dropped.

"Someone had broken into Sarah's old bedroom.""

I felt the air leave my lungs.

"Did they find anything?""

Daniel hesitated.

Then he answered.

"Her original medical records are missing.""

And suddenly, I understood what Richard had meant.

May you like

The fake agreement wasn't the only thing they needed to make their plan work.

They needed to erase the proof that Sarah had never signed it.
