Amused

Chapter 8: The Sister's Secret

Marcus couldn't speak.

For seven years, Rachel had been the person he trusted when everything else in his life felt uncertain.

She had helped him through the divorce.

She had attended every court hearing she could.

She had taken Ava into her home when the temporary custody arrangements became difficult.

And now her name appeared on the hidden document beside instructions concerning the recording that had nearly destroyed him.

“Rachel,” he said carefully, “what second copy?””

There was a long silence.

Then she answered.

“The original recording wasn't the only file Vanessa gave me.””

Marcus stared at the phone.

“You have a copy?””

“Yes.””

Daniel moved closer and gestured for Marcus to put the call on speaker.

Marcus did.

“Rachel, this is Daniel Brooks. I'm here with Marcus. Please tell us exactly what happened, starting with when Vanessa contacted you.””

Rachel took a shaky breath.

“She called me about two weeks after March 14. She said she was worried about Marcus and wanted me to understand why she was filing for divorce. She sent me a video.””

“What did the video show?”” Daniel asked.

“The argument in the kitchen. Vanessa yelling. Marcus asking what was wrong with Ava. The glass breaking.””

“Did it contain the part where Vanessa instructed Ava to scream?””

“No.””

Marcus shut his eyes.

“Did you know that part existed?””

“No. Not then.””

Daniel asked, “Why did you keep the video?””

Rachel's voice became quieter.

“Because I didn't believe it told the whole story.””

Marcus felt a flash of anger.

“You watched it and didn't tell me?””

“I tried to talk to Vanessa first. She said the video had been taken out of context, but she also said Marcus had a temper and that I didn't know everything that happened behind closed doors.””

“So you believed her?””

“I didn't know what to believe!””

Rachel's voice cracked.

“I was afraid that if I dismissed her concerns and something really happened to Ava, I'd never forgive myself. But I also knew Marcus. I knew the video looked strange because it began just before the argument.””

Daniel interrupted gently.

“Ms. Reed, did Vanessa tell you the recording had been edited?””

“No. She said it was a copy from a home security system.””

“Did she ask you to do anything with it?””

“Yes. She asked me to keep it somewhere safe and not share it until she knew what she was going to do.””

Marcus gripped the phone.

“And you agreed?””

“I agreed to keep it. I didn't agree to help her accuse you.””

“But you never told me.””

“I thought I was staying out of it. I thought if I held onto it, I could make sure nobody changed anything else.””

Daniel asked, “Do you still have the file?””

“Yes.””

“Has it been altered since you received it?””

“Not by me. I saved the original attachment and the message Vanessa sent with it.””

Daniel exchanged a glance with Marcus.

“Please preserve the original device and messages. Don't forward the file or modify it. We'll arrange for an appropriate examination through counsel.””

Rachel began crying.

“Daniel, I need you to understand something. I didn't know about the part with Ava until yesterday. I heard the courtroom recording on the news report someone sent me, and I realized the file Vanessa gave me wasn't complete.””

Marcus felt his anger shift into something more complicated.

“Why didn't you call me last night?””

“Because Vanessa called first. She said if I gave the file to you, I'd be helping destroy Ava's family. She said I would be responsible if Ava never wanted to see me again.””

Marcus closed his eyes.

Rachel had spent years being the person who stood between him and disaster.

Now Vanessa had found a way to make his sister afraid of becoming the next target.

“Rachel,” he said, “you need to tell the truth. Whatever happens after that, we will deal with it.””

“I know.””

“Do you still have the message where she sent you the file?””

“Yes.””

“Then preserve everything. Please.””

“I will.””

When the call ended, Marcus sat motionless.

Daniel waited before speaking.

“Your sister may be a witness. We need to keep her separate from the investigation and avoid coaching her about what to say.””

“I know.””

“We also need to be careful about the chain of custody. If she has a file that may be relevant, her attorney can arrange a proper transfer for examination.””

Marcus nodded.

Then he looked at Daniel.

“Do you think Rachel knew?””

“I don't know. Her account is consistent with someone who received a shortened video and became suspicious of it. But we need corroboration.””

Marcus rubbed his forehead.

“What if she was part of it?””

“Then the evidence will help establish that. But we won't accuse her without support.””

That afternoon, Rachel met with her own attorney and provided a written account of what she remembered. She authorized the preservation of the original message and attachment, and the file was transferred for examination through the agreed legal process.

The examiner compared the file with the version James Cole had preserved.

The two recordings contained the same central argument, but Rachel's file began later than the original.

It had already been shortened before Vanessa sent it to her.

The examiner could not determine from that copy alone who had performed the edit.

However, the message accompanying it contained an instruction from Vanessa.

Please keep this version. Don't circulate the full file. I need time to decide what to do.

Daniel read the message twice.

“This establishes that Vanessa deliberately chose to send your sister a shortened version,” he told Marcus.

“It doesn't establish every motive behind that choice, but it's relevant.””

Marcus stared at the screen.

“Why send it to Rachel at all?””

“Possibly to influence her opinion of you. Possibly because she wanted Rachel to support her custody position. We need more evidence before drawing a conclusion.””

Daniel prepared a supplemental filing describing the newly discovered material and requested permission to question Rachel about the file and the message.

Judge Williams scheduled a further hearing.

Meanwhile, the child advocate completed an initial meeting with Ava and submitted a confidential recommendation concerning the child's emotional well-being.

The court did not release the report to the public gallery.

Instead, Judge Williams reviewed it privately and directed that Ava receive appropriate support while the adults continued the proceedings.

Marcus was grateful for that decision.

Ava had already endured enough.

The next hearing began on Friday morning.

Vanessa arrived wearing a dark navy dress and no jewelry. She looked tired, but when she saw Rachel entering the courtroom, her expression hardened.

“You promised me,” Vanessa whispered as Rachel passed.

Rachel stopped.

“I promised to keep a file safe. I never promised to lie.””

Vanessa stepped closer.

“You have no idea what you've done.””

Rachel looked her in the eye.

“Neither did you.””

Peter Lawson immediately intervened.

“Both of you, stop. This is a courtroom.””

Rachel took her seat beside her attorney.

Vanessa turned away, her face flushed.

Judge Williams entered and called the hearing to order.

Daniel presented the examiner's preliminary findings concerning the shortened recording, along with the message Vanessa had sent Rachel.

Peter objected to the interpretation of the message.

“It shows only that Mrs. Reed sent a copy to a family member. It does not prove that she altered it or intended to mislead the court.””

Judge Williams nodded.

“That distinction is noted. The court will consider the message for what it actually establishes, not for assumptions about its meaning.””

Daniel then called Rachel to testify.

Rachel swore to tell the truth and took the witness stand.

She described receiving the file, preserving the original message, and questioning why the video began in the middle of the incident.

“Did Mrs. Reed ask you to testify against your brother?”” Daniel asked.

“No.””

“Did she ask you to tell anyone that you had witnessed him behaving violently?””

“No.””

“Did you ever witness Mr. Reed strike his daughter?””

“No.””

“Did you ever witness him strike Mrs. Reed?””

“No.””

Peter rose for cross-examination.

“Ms. Reed, you are the defendant's sister, correct?””

“Yes.””

“You love your brother.””

“Yes.””

“And you want him to regain custody of his daughter.””

Rachel paused.

“I want Ava to be safe and loved.””

“That's not what I asked.””

“Then yes, I want Marcus to have a fair chance to parent his daughter.””

Peter walked toward the witness stand.

“You kept a recording that might have helped Mrs. Reed protect herself. You didn't immediately turn it over to the court. Isn't that true?””

“I kept the file because I wasn't sure what it showed.””

“So you withheld potentially relevant evidence.””

“I preserved it. I didn't destroy it or alter it.””

“You didn't tell your brother about it, either.””

Rachel's eyes filled with tears.

“No. I should have.””

Peter lifted the printed message.

“And when Mrs. Reed told you not to circulate the full file, you obeyed her.””

Rachel looked at the page.

“I obeyed her request to keep the file private while I tried to understand what was happening. I didn't know there was a full recording showing her instructing Ava to scream.””

Peter raised an eyebrow.

“Convenient.””

Rachel turned toward him.

“You want to know what's convenient? You keep asking why I didn't act sooner, but nobody is asking why Vanessa sent me a video she knew didn't show the beginning.””

Peter's face tightened.

Judge Williams raised a hand.

“Ms. Reed, answer the questions put to you. Mr. Lawson, refrain from editorial comments.””

Rachel lowered her gaze.

“Yes, Your Honor.””

The cross-examination continued for another twenty minutes.

When it ended, Daniel asked one final question.

“Ms. Reed, why are you testifying now?””

Rachel looked toward Marcus.

“Because Ava is five years old. She should never have been asked to scream for help when she wasn't being hurt. And my brother should never have been accused of something I now know the evidence may contradict.””

Her voice broke.

“I kept the file because I was afraid of making the wrong decision. But keeping quiet was a decision, too.””

Marcus lowered his head.

He was angry with her.

He was grateful to her.

And he was beginning to understand that Vanessa's manipulation had not depended solely on lies. It had depended on making everyone around her afraid that telling the truth would cause even more damage.

After Rachel stepped down, Judge Williams addressed the attorneys.

“The evidence now suggests that a shortened recording was circulated before the custody allegations were formally pursued. The court has not determined who created the shortened version or whether every statement made by every witness was knowingly false. Those issues require further examination.””

She paused.

“However, the court is concerned that the child may have been drawn into adult conflict in a manner that could cause emotional harm.””

Vanessa stared at the table.

Judge Williams continued.

“I am considering whether the temporary custody arrangement should be modified while this matter is investigated.””

Marcus's heart began to race.

Peter stood.

“Your Honor, we strongly oppose any immediate change. Mrs. Reed has been Ava's primary caregiver.””

Daniel rose in response.

“And Mr. Reed has complied with every court order, has no established history of violence, and is now facing allegations that appear to have been supported by a potentially misleading recording and a disputed witness statement.””

The judge held up her hand.

“I have heard both sides.””

She called for a short recess to review the filings.

Marcus stepped into the corridor with Daniel.

“What do you think she'll do?””

“It's impossible to predict. She'll consider the child's best interests, the existing arrangement, and the reliability of the evidence.””

Rachel approached them.

“I am so sorry.””

Marcus looked at her.

“I need time.””

“I know.””

“I don't know whether you made the right choice back then.””

Rachel nodded, tears running down her cheeks.

“Neither do I.””

“But you told the truth today.””

She wiped her face.

“It's the least I could do.””

Before Marcus could answer, his phone vibrated.

A message had arrived from Vanessa's number.

*You think the recording proves everything. It doesn't.*

A second message followed.

*Ask Rachel what she saw in the background of the original video.*

Marcus looked up.

Rachel had gone pale.

Daniel noticed.

“What is it?””

Marcus showed him the messages.

Daniel's expression sharpened.

“Rachel, did you see anything in the original video that you haven't told us about?””

Rachel stared at the phone.

“I didn't think it mattered.””

“What didn't matter?””

She swallowed.

“In the background, near the kitchen doorway, there was a folder on the counter.””

Marcus frowned.

“What folder?””

“I couldn't read the label. But I could see your name written on it.””

Daniel asked, “Did you tell Vanessa you noticed it?””

Rachel nodded.

“She told me it was just paperwork from the divorce.””

Marcus's pulse quickened.

“What else?””

Rachel closed her eyes.

“There was another person in the reflection of the glass cabinet. I thought it was a neighbor standing in the hallway.””

“Did you recognize them?””

“No.””

“Could you identify them now?””

Rachel hesitated.

Then she whispered, “I think I could.””

The courtroom doors opened.

A court officer announced that Judge Williams was ready to resume.

Marcus followed Daniel inside, but his mind remained fixed on the figure in the reflection.

Vanessa had claimed she acted alone.

James had identified Peter Lawson's voice.

Rachel had preserved a shortened recording.

And now there might have been another person present before the argument even began.

Judge Williams took the bench.

“After reviewing the current record, the court will modify the temporary visitation arrangement to permit expanded contact between Mr. Reed and his daughter, with appropriate safeguards while the investigation continues. This is an interim decision, not a final custody ruling.””

Marcus gripped the edge of the table.

He would see Ava more often.

He could finally begin rebuilding the routine that had been taken from them.

But the judge wasn't finished.

“Given the conflicting evidence, the court also directs the parties to preserve any original recordings, communications, and documents relating to the March 14 incident. The court will revisit custody after the remaining issues have been examined.””

Vanessa looked up sharply.

For the first time, she appeared to realize that her own attempts to control the evidence had given the court a reason to examine every part of her story.

Then Rachel leaned toward Marcus.

“I remember who was standing in that reflection,” she whispered.

He turned.

“Who?””

Rachel looked toward Vanessa.

May you like

Then she said a name Marcus never expected to hear.

“Your father.””
